1) Notice of Infringement (DMCA Takedown Notice)

  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).

  4. Your contact information, including:

    • Full name

    • Physical address

    • Email address

    • Telephone number

    • Fax number (if available)

  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, the owner’s agent, or the law.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Important legal notice: Title 17 U.S.C. §512(f) provides for civil damages, including costs and attorney fees, against any person who knowingly and materially misrepresents information in a DMCA notification.

2) Counter-Notification (Request to Restore Material)

If you believe content was removed or disabled due to mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include substantially the following elements pursuant to 17 U.S.C. §512(g)(3):

  1. Your physical or electronic signature.

  2. A description of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled (please include the URL).

  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.

  4. Your name, address, and telephone number, and a statement that you:

    • Consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, consent to jurisdiction of any judicial district in which the service provider may be found), and

    • Will accept service of process from the person who submitted the original DMCA notice (or their agent).
